1. Agreement to Terms

By accessing or using the GrassID mobile application ("App") and website at grassid.com ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access our services.

2. Description of Service

GrassID provides an AI-powered grass identification and lawn care management platform that includes:

• Grass species identification through photo recognition
• Lawn disease and pest diagnosis
• Personalized lawn care schedules and recommendations
• Grass Assistant for lawn care guidance
• Seasonal care reminders and weather-based alerts
• Educational content and lawn care guides

3. Account Registration

To access certain features of our App, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. Subscription and Payments

Free Features

Basic grass identification features are available free of charge with limited daily uses.

Premium Subscription

Premium features require a paid subscription, which includes:

• Unlimited grass identifications
• Advanced disease and pest diagnosis
• Detailed personalized care plans
• Priority access to Grass Assistant
• Ad-free experience

Billing

• Subscriptions are billed through the Apple App Store
• Subscription fees are charged in advance on a recurring basis
• Prices are subject to change with reasonable notice
• All payments are non-refundable except as required by law

5. User Content and Conduct

Your Content

By uploading photos or other content to our App, you:

• Grant us a non-exclusive, worldwide, royalty-free license to use, process, and analyze your content for providing and improving our services
• Represent that you own or have the right to use the content
• Agree that your content will not violate any third-party rights

Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms
• Upload inappropriate, offensive, or misleading content
• Attempt to reverse engineer, decompile, or hack the App
• Use automated systems or bots to access the App
• Interfere with or disrupt the App's functionality
• Impersonate another person or entity
• Share your account with others

6. Intellectual Property Rights

The App and its original content, features, and functionality are owned by GrassID and are protected by international copyright, trademark, and other intellectual property laws. Our AI models, algorithms, and proprietary technology remain our exclusive property.

7. Accuracy of Information

While we strive for accuracy in our grass identification and lawn care recommendations:

• Results are based on AI analysis and may not be 100% accurate
• Recommendations should be considered as guidance, not professional landscaping advice
• Local conditions and specific lawn circumstances may affect results
• We are not responsible for lawn damage resulting from following app recommendations

8. Third-Party Services

Our App may contain links to third-party websites or services that are not owned or controlled by GrassID. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

• The App will function uninterrupted or error-free
• Defects will be corrected promptly
• The App is free of viruses or harmful components
• Results from the App will be accurate or reliable

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRASSID SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM:

• Your use or inability to use the App
• Any unauthorized access to your data
• Any bugs, viruses, or errors in the App
• Any lawn damage or plant loss
• Personal injury or property damage related to your use of the App

11. Indemnification

You agree to indemnify, defend, and hold harmless GrassID, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the App or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the App will immediately cease
• We may delete your account and associated data
• Paid subscriptions will continue until the end of the current billing period

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GrassID regarding the use of our App and supersede any prior agreements.

18. Apple App Store Additional Terms

If you download our App from the Apple App Store, you also agree to Apple's Terms of Service and acknowledge that:

• These Terms are between you and GrassID, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any product warranties or claims
• Apple is a third-party beneficiary of these Terms with the right to enforce them
